The first step in the conveyancing and settlement process is to engage a registered conveyancer or lawyer. Once you have engaged a professional, they will begin the process by checking that the property you are interested in is able to be transferred and that there are no outstanding issues with the title.

In Western Australia, electronic conveyancing is now standard for settlements which makes the process much more efficient.

Depending on whether you are buying or selling a property, there are different requirements for each stage of the settlement process.

In Western Australia, the standard residential property sale contract has two parts:

• Contract for Sale of Land or Strata Title by Offer and Acceptance (the O & A)
• Joint Form of General Conditions for the Sale of Land (General Conditions)

These are generally standard form documents, but we are able to prepare, review, and vary a contract of sale if required.

Once the contract has been signed, your conveyancer will request a property information report from the local council. This report includes information about the property, such as zoning, strata, building approval history and any encumbrances on the property.

Your conveyancer will also request a title search from Landgate, which will provide information about who owns the property and whether there are any restrictions or easements on the property title.

At this stage, your conveyancer will also prepare a settlement statement, which itemises all the settlement fees and charges that are payable.

They can also liaise with your bank or private lender in order to make arrangements for the:

• Discharge of your mortgage if you are the seller and have a mortgage registered against your property.
• Registration of the mortgage if you are the buyer and you are obtaining finance to purchase a property.

On the day of settlement, your conveyancer will attend the agreed location for settlement to among other things exchange and lodge all the necessary documents and transfer funds.

Both parties will be notified as soon as the settlement comes into effect.
